So for some reason I got on a law search today. Okay so I was cold, unmotivated, and wanted some distraction. For poly folks out there, this may be thought provoking or not.

Most marriage/sex related law is on a state by state basis.

Fornication laws cover people who are not married living together.

Adultery laws deal with people who are married and have sex outside their marriage.

Common law actually has multiple requirements other than living together. It also does not have a fixed time limit on how long you need to live together.

Taking this into account, it's not illegal to have multiple partners living together unmarried as long as they are not married (to anyone) and there are no fornication laws in the state in question. They are only married under common law if they represent themselves as married (take the same last name, refer to each other as husband/wife, etc).

Do these facts have any effect on my life at the moment. No, but I'm still optimistic that someday such legalities will be of concern.
